8.01.040 Membership Court
(a) A person who feels that he/she has been dealt with unfairly by the Tribal Clerk may appeal for redress to the Membership Court.
(b) Any member of the Tribe who feels that a person has been denied membership to the Tribe, in violation of the Membership Code, may apply to the Membership Court for redress.
(c) Any member of the Tribe who feels that a person has been granted membership to the Tribe in violation of the Membership Code, may apply to the Membership Court for redress.
(d) An appeal or grievance shall be filed with the Tribal Clerk within ninety (90) days unless they have good cause for needing more than ninety (90) days time. The Tribal Clerk in turn shall forward a copy of the appeal or grievance to the membership Court.
(e) The Membership Court shall meet within thirty (30) days of the filing of an appeal or grievance.
(f) The person filing the appeal or grievance shall be given the date of the hearing by the Tribal clerk.
(g) The Membership Court will hear evidence, can seek additional evidence and shall render a decision based on the Membership Code.
(h) The three (3) Sub-Chiefs shall comprise the Membership Court.
(i) Should a vacancy occur in the Membership Court, the Tribal chiefs shall appoint an individual until the next tribal election at which time the position will be filled by the regular election process.
(j) Impeachment process: A Judge may be impeached by the Tribal Council for dereliction of duties. Dereliction of duties is defined as follows:
(1) Failure to appear for three (3) consecutive meetings;
(2) Deliberate obstruction of court process.
